Welcome to BINGE BEYOND. These Terms of Use (“Terms”) govern your access to and use of our applications, website, and services (collectively, the “Service”).
By creating an account, subscribing, or using our Service, you are confirming that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you may not use the Service
These Terms, together with our Privacy Policy, constitute the entire legal agreement between you and BingeBeyond (“we”, “us”, “our”).
This section is critical. Your understanding of our Service’s nature is a condition of its use.
BINGE BEYOND is a Performance Tool: Our Service is a software tool that uses selective routing technology to provide you with faster and more reliable access to geo-restricted content on third-party streaming platforms.
BINGE BEYOND is NOT a Security or Anonymity Service: The Service is not a traditional Virtual Private Network (VPN). It is not designed for and should not be used for security, privacy protection, or general anonymity online. It does not encrypt all your traffic or hide your IP address for all activities. By using the Service, you acknowledge and agree that you will not rely on it for any security or privacy purposes.
To use the Service, you must create an account. You agree to provide accurate information (such as your email for paid accounts) and to keep this information updated. You are solely responsible for all activity that occurs under your account and for keeping your password confidential and secure.
Free Tier:We may offer a free tier of service, which is subject to limitations (e.g., time limits, ad-support) that we may change at any time.
Paid Subscriptions: For paid tiers, you agree to pay the fees specified at the time of purchase. Subscriptions will automatically renew for the same billing cycle unless you cancel before the renewal date.
Cancellations: You may cancel your subscription at any time through your account settings. Your access will continue until the end of your current billing period.
Refund Policy: We stand behind our service. If BINGE BEYOND does not work for you, we offer a 30-day money-back guarantee for your first payment. Beyond this initial period, fees are non-refundable.
Your right to use the Service is conditional upon your strict adherence to this policy. You agree NOT to use the Service to:
Engage in any illegal activity:This includes, but is not limited to, violating copyright laws, downloading or sharing pirated content, or committing fraud.
Circumvent our service limitations: You may not attempt to bypass the time limits of our free tier or otherwise abuse our service infrastructure.
Interfere with the Service: You may not attempt to reverse-engineer, decompile, or disrupt the integrity or performance of the Service or its underlying code.
Transmit malicious content:You may not use the Service to distribute malware, viruses, or any other harmful computer code.
Violation of this Acceptable Use Policy may result in the immediate suspension or termination of your account without a refund.
This is a key condition of your use of BINGE BEYOND.
Third-Party Terms: You acknowledge that third-party streaming services have their own terms of use, which may prohibit the circumvention of their geo-blocking measures.
Assumption of Risk: You acknowledge that using BINGE BEYOND to access such content may be a violation of those third-party terms. You agree that you are using our Service at your own risk and are solely responsible for ensuring that your use complies with the terms of any other service.
No Guarantee of Access: We provide a tool to facilitate access, but we do not guarantee that the Service will successfully unblock any specific streaming platform at all times. Streaming services may update their technology to block our Service, which may result in temporary or permanent outages for which we are not liable.
The Service is provided on an “as-is” and “as-available” basis. We make no warranties, express or implied, that the Service will be uninterrupted, error-free, or completely secure. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability or fitness for a particular purpose.
To the maximum extent permitted by applicable law, in no event shall BINGE BEYOND, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Service. Our total liability to you for any and all claims related to the Service shall not exceed the amount you paid us, if any, in the 12 months preceding the claim.
We reserve the right to suspend or terminate your account at any time, without notice or refund, if you are found to be in breach of these Terms, particularly the Acceptable Use Policy. You may terminate your account at any time by cancelling your subscription.
These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in Singapore, in accordance with the rules of the Singapore International Arbitration Centre
Amendments: We may modify these Terms from time to time. We will provide notice of significant changes. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
